Letter of Syed Adeeb to Pakistani PM
Dear PPP Prime Minister Syed Yousaf Raza Gillani:
(InformPress.com) – You must take the following actions before 30 April 2008 through your Executive Order or Prime Minister’s Order as promised in the Bhurban (Murree) Declaration of 9 March 2008 – signed by PPP Co-Chairman Asif Ali Zardari and PML-N Chief Muhammad Nawaz Sharif, and endorsed by ANP President Asfandyar Wali Khan – and the Charter of Democracy of 14 May 2006, signed by assassinated PPP Chairwoman Benazir Bhutto and PML-N Quaid Nawaz Sharif:
(1) Reinstate all illegally deposed justices of the Supreme Court of Pakistan (SCP), including SCP Chief Justice Iftikhar Muhammad Chaudhry, quickly after the National Assembly adopts its resolution to restore all those SCP judges who rejected the illegal orders of the unlawful president.
(2) Restore all unlawfully suspended judges of provincial high courts promptly after the National Assembly passes its resolution to reinstate all those judges of the provincial high courts of Pakistan who refused to accept the unlawful orders of the illegal president.
(3) Criminal outlaw Pervez Musharraf is an unconstitutional, illegal and fake president who has commited many barbarous crimes, including the crime of High Treason, during 1999 to 2008. On 3 November 2007, Tyrant Musharraf illegally issued the illegal Provisional Constitution Order (PCO) No. 1 of 2007, the unlawful Proclamation of Emergency (POE) and the illegal Oath of Office (Judges) Order (OOJO) 2007 to dismiss an independent judiciary and to run the legislative, judicial and executive branches of the federal as well as the four provincial governments like his personal kingdoms or businesses.
(4) Therefore, fire, arrest or impeach, prosecute and punish Dictator Musharraf and all current, unconstitutional, illegal PCO justices of the SCP and judges of the four provincial high courts of Punjab, Sindh, NWFP and Balochistan for High Treason under Article 6 of the Constitution of Pakistan and under the High Treason (Punishment) Act, 1973.
(5) Indeed, the Prime Minister; federal Cabinet of PPP, PML-N, ANP and JUI-F ministers; the Parliament (National Assembly and Senate); new independent judges; prosecutors and the police can fire, arrest or impeach, prosecute and punish the illegal president and all unlawful justices under the Constitution and laws of Pakistan, because the unlawful president and all illegal judges are criminal imposters.
(6) The parliamentary resolution or your Executive Order should also state that all reinstated justices of the Supreme Court and all restored judges of provincial high courts will take new oaths of their offices under Articles 178 and 194 of the 1973 Constitution of Pakistan (without any illegal amendements of the unlawful president). Ms. Fahmida Mirza, the National Assembly Speaker, whom I nominated as the Acting President of Pakistan, on 1 April 2008, or SCP Chief Justice Iftikhar Muhammad Chaudhry can administer the new oaths for all new judges, new federal ministers or ministers of state, new provincial governors, new Chief Election Commissioner, new Auditor-General of Pakistan, new Prime Minister and new President.
(7) The Parliament (National Assembly or Senate) or the federal Cabinet should not commit the crime of reducing the tenure of the Chief Justice of Pakistan (CJP), Mr. Iftikhar Muhammad Chaudhry, or any other legal judge or justice through a constitutional amendment, a parliamentary resolution, an order or a law. Mr. Iftikhar Chaudhry must be allowed to work honorably as the Supreme Court Chief Justice until his retirement in December 2013.
[8] It is common knowledge that Pervez Musharraf is an unconstitutional, illegal, outlaw, fraudulent and fake president. Therefore, the PCOs and all other orders, ordinances or amendments issued by Tyrant Musharraf are also unconstitutional, unlawful and unenforceable. The Parliament, Judiciary or any other body does not have the constitutional mandate or legal authority to approve, validate or legitimize the PCOs, orders, ordinances or amendments of Dictator Musharraf. There is no Article, clause or provision in the current Constitution of Pakistan to legalize the orders, ordinances, amendments or crimes of Criminal Musharraf. The crimes and misdeeds, especially the crime of High Treason, of any Army Chief, General, President, Prime Minister, Governor, Chief Minister, Minister, MNA, Senator, MPA or any other government official canNOT be authorized, legalized or forgiven by any Act of Parliament or any Order of the high courts or Supreme Court of Pakistan AFTER these illegal acts are committed by the official criminals.
(9) In your Executive Order or your statements, you should tell the whole truth that the President has NO constitutional or legal authority, power or right to suspend or dismiss the Chief Justice of Pakistan (CJP), or any other justice of the Supreme Court or any judge of provincial high courts of Pakistan.
(10) If you want the Pakistani people, free press and independent media to support your administration, then you and the 24 federal ministers should stop acting like the puppets, servants, slaves or advocates of Devil Musharraf. The PPP, PML-N, ANP, JUI-F, PML-Q, MQM and any other political party of Pakistan should not cut any more corrupt deals with Dictator Musharraf. I hope you will break your chains of slavery, gain freedom and take all actions requested in this letter.
